Neutralność sieci w krajach Unii Europejskiej
ISOC Polska podtrzymuje swoje stanowisko z 5 sierpnia 2011 o potrzebie uzupełnienia ustawy problematyką neutralności sieci.
To nasze stanowisko zostało w minimalnym stopniu uwzględnione w wersji projektu nowelizacji z 13 października 2011. Przyjęty został nasz postulat, aby UKE opracowywało coroczny raport na temat stanu neutralności sieci, nie uwzględniono naszych propozycji określających tę problematykę. Jeszcze mniejszym stopniu uwzględniono kwestię neutralności sieci w wersji projektu z 12 lutego 2012.
Jednakże w trakcie spotkania konsultacyjnego w dniu 13 lutego 2012 minister Igor Ostrowski stwierdził, że sprawa nie jest zamknięta, bo ramach dyspozycji premiera Donalda Tuska wynikającej ze spotkania z 6 lutego wśród 10 punktów pakietu przedsięwzięć mających na na celu "obronę wolności w Internecie" znajduje się także kwestia neutralność sieci. W związku z tym oświadczeniem ISOC Polska przygotował "Informację o proponowanych zapisach dotyczących Neutralności Sieci wprowadzanych w innych państwach UE przy okazji transpozycji Pakietu Telekomunikacyjnego".

Text of the Amendment:
Member States shall ensure that any restrictions to users' rights to access content, services and applications, if they are necessary, shall be implemented by appropriate measures, in accordance with the principles of proportionality, effectiveness and dissuasiveness. These measures shall not have the effect of hindering the development of the information society, in compliance with the Directive 2000/31/EC, and shall not conflict with citizens' fundamental rights, including the right to privacy and the right to due process.
ISOC-ECC
- recognised the Net Neutrality principle which Amendment 166 addresses as one of the key principles of an open Internet,
- notes that the European Union had already recognised (during the WSIS process) the end-to-end principle as a fundamental technical principle of the Internet and welcomes the will of the European Parliament to now translate it in a political one through the Net Neutrality principle. The end-to-end and Net Neutrality principles both state that the focus of policy should be on senders and receivers of messages rather than the channel carrying them,
- calls on the EU Council of Ministers to maintain this amendment. In view of the general trend towards universal access to broad band Internet and the migration of an increasingly wide range of public and private services to the Internet, it is untenable and counterproductive to apply any restrictions to users' rights other than through well defined and codified procedures, fully compatible with applicable law,
- calls for further work on the Net Neutrality principle after the adoption of the Telecom Package in order to refine the Net Neutrality principle and render it effective.

Komisja przywiązuje wielką wagę do zachowania otwartości i neutralności internetu, z pełnym uwzględnieniem intencji współustawodawców, którzy pragną uczynić z neutralności sieci jeden z celów polityki i zasad regulacyjnych promowanych przez krajowe organy regulacyjne [1], a także do wzmocnienia związanych z tym wymogów w zakresie przejrzystości [2] oraz dania krajowym organom regulacyjnym uprawnień pozwalających im zapobiegać pogarszaniu się jakości usług i utrudnianiu lub spowalnianiu ruchu w sieciach publicznych [3].

The principle of neutrality should be defined in the law as:
(i) Internet users’ ability
(ii) to send and receive the content of their choice, to use services or run applications of their choice, connect the equipment and use the programs of their choice provided they don’t impair the network,
(iii) with a transparent, sufficient, and non-discriminatory quality of service,
(iv) and subject to the obligations resulting from legal proceedings and the measures required for security reasons and unforeseen congestion.
Position: these provisions could be inserted in article L. 32-1 of the Postal and Electronic Communications Code (creation of a IV).

The Netherlands is the first country in Europe to introduce a net neutrality law. In addition, provisions were launched protecting users against disconnection and wiretapping by providers.

32. Nach § 41 wird folgender § 41a eingefügt:
§ 41a Netzneutralität
- Die Bundesregierung wird ermächtigt, in einer Rechtsverordnung mit Zustimmung des Bundestages und des Bundesrates gegenüber Unternehmen, die Telekommunikationsnetze betreiben, die grundsätzlichen Anforderungen an eine diskriminierungsfreie Datenübermittlung und den diskriminierungsfreien Zugang zu Inhalten und Anwendungen festzulegen, um eine willkürliche Verschlechterung von Diensten und eine ungerechtfertigte Behinderung oder Verlangsamung des Datenverkehrs in den Netzen zu verhindern; sie berücksichtigt hierbei die europäischen Vorgaben sowie die Ziele und Grundsätze des § 2.
- Die Bundesnetzagentur kann in einer Technischen Richtlinie Einzelheiten über die Mindestanforderungen an die Dienstqualität durch Verfügung festlegen. Bevor die Mindestanforderungen festgelegt werden, sind die Gründe für ein Tätigwerden, die geplanten Anforderungen und die vorgeschlagene Vorgehensweise zusammenfassend darzustellen; diese Darstellung ist der Kommission und dem GEREK rechtzeitig zu übermitteln. Den Kommentaren oder Empfehlungen der Kommission ist bei der Festlegung der Anforderungen weitestgehend Rechnung zu tragen.

- die Gewährleistung von Netzneutralität als eines der Regulierungsziele des TKG aufzunehmen; die Motive hierfür sind in der Gesetzesbegründung zu erläutern; insbesondere sollen die Netzneutralität und die damit verbundenen niedrigen Marktzugangsschranken die Vielfalt von Inhalten, Diensten und Diensteanbietern fördern, die wiederum der Meinungs- und Wirtschaftsfreiheit und dem technischen Fortschritt dient; in der Sache geht es darum, das Verlangsamen, Benachteiligen oder Blockieren von Inhalten, Diensten oder Diensteanbietern ohne hinreichenden sachlichen Grund zu verhindern;
- den Begriff der Netzneutralität im Sinne einer grundsätzlichen Gleichbehandlung aller Datenpakete unabhängig von Inhalt, Dienst, Anwendung, Herkunft oder Ziel zu definieren;
- das Prinzip festzuschreiben, dass jeder Nutzer von Telekommunikationsdiensten grundsätzlich Zugang zu jedem Inhalt bzw. jeder Anwendung im Internet haben muss bzw. dass grundsätzlich jeder Inhalte im Internet anbieten kann;

Neutralność sieci w Holandii
Kampania społeczna w Holandii na rzecz neutralności sieci odniosła sukces. 8 maja 2012 druga izba parlamentu zatwierdziła wprowadzone jeszcze na jesieni zmiany w prawie telekomunikacyjnym. Nowe przepisy powalają na inspekcję pakietów (DPI) oraz odcinanie od sieci tylko w wyjątkowych przypadkach.
Holandia jest pierwszym państwem w Europie, a drugim w świecie - po Chile, w którym będą obowiązywać przepisy ustawowe o neutralności sieci.
